2. Intellectual and Industrial Property

This website and the content it contains are protected by current legislation on intellectual property.

Vexia Tech LLC holds ownership or licensing rights over all intellectual and industrial property rights of its website, as well as over all elements contained therein. Therefore, reproduction, distribution, public communication, and transformation of all or part of the contents of this website for commercial purposes, in any medium or by any technical means, are expressly prohibited without the authorization of Vexia Tech LLC in its Terms and Conditions.

The trademarks, trade names, or distinctive signs are the property of Vexia Tech LLC, whether by industrial or intellectual ownership, and access to the Portal shall not be understood as granting any right over said trademarks, trade names, and/or distinctive signs.

All products and services on these pages that are NOT owned by Vexia Tech LLC are registered trademarks of their respective owners and are recognized as such by our company. They appear on the Vexia Tech LLC website solely for promotional and informational purposes. These owners may request the modification or removal of information that belongs to them.

3. Conditions of Use of the Portal

3.1 General

The User undertakes to use the Portal in accordance with the Law and this Legal Notice. The User will be liable to Vexia Tech LLC or to third parties for any damages that may arise as a consequence of failing to comply with this obligation.

The use of the Portal for purposes that harm the property or interests of Vexia Tech LLC or third parties, or that overload, damage, or disable networks, servers, and other computer equipment (hardware) or computer applications (software) of Vexia Tech LLC or third parties, is expressly prohibited.

3.2 Contents

The User undertakes to use the Contents in accordance with the Law and this Legal Notice, as well as with any other conditions, regulations, and instructions that may apply pursuant to clause 1.

By way of example, the User must refrain from the following actions, in accordance with current legislation:

  • Reproducing, copying, distributing, making available, publicly communicating, transforming, or modifying the Contents except in cases authorized by law or expressly consented to by Vexia Tech LLC or the owner of the exploitation rights.
  • Reproducing or copying for private use any Contents that may be considered Software or Databases in accordance with current legislation on intellectual property, as well as publicly communicating them or making them available to third parties when such acts imply reproduction by the User or a third party.
  • Extracting and/or reusing all or a substantial part of the Contents on the Portal, as well as the databases that Vexia Tech LLC makes available to Users.

3.3 Introducing Links to the Portal

Any Internet user wishing to include links from their own web pages to the Portal must comply with the following conditions, and ignorance of these conditions will not exempt them from legal responsibility:

  • The link may only link to the home page or main page of the Portal but may not reproduce it in any form (online links, copy of texts, graphics, etc.).
  • The establishment of frames or any other type of structure that surrounds the Portal or allows the display of the Contents through Internet addresses other than those of the Portal is prohibited, as is the simultaneous display of the Contents with external content in such a way that: (I) it causes or may cause error, confusion, or deception among users about the true origin of the service or Contents; (II) constitutes an act of unfair comparison or imitation; (III) takes advantage of the reputation of the Vexia Tech LLC brand; or (IV) is in any way prohibited by applicable law.
  • No false, inaccurate, or incorrect statements about Vexia Tech LLC, its partners, employees, clients, or the quality of its services may be made from the page containing the link.
  • Under no circumstances may it be stated on the linking page that Vexia Tech LLC has authorized the inclusion of the link or that it sponsors, collaborates, verifies, or supervises the services of the sender.
  • The use of any trademark, logo, or other distinctive sign of Vexia Tech LLC within the linking page is prohibited unless permitted by law or expressly authorized by Vexia Tech LLC, and provided that, in such cases, a direct link to the Portal is established as specified in this clause.
  • The page establishing the link must fully comply with the law and may not contain or link to content belonging to the sender or third parties that: (I) is illegal, harmful, or contrary to morality and good customs (pornographic, violent, racist, etc.); (II) may induce in the User the false belief that Vexia Tech LLC endorses, backs, adheres to, or supports the sender’s lawful or unlawful ideas, statements, or expressions; (III) is inappropriate or irrelevant to Vexia Tech LLC’s activities, considering the content and theme of the sender’s website.

4. Disclaimer of Liability

4.1 Concerning Information

Vexia Tech LLC is not responsible for decisions made based on the information provided on the Portal nor for damages caused to the User or third parties as a result of actions based solely on the information obtained from the Portal.

4.2 Concerning Service Quality

Access to the Portal does not imply an obligation on the part of Vexia Tech LLC to control the absence of viruses, worms, or any other harmful computer element.

The User is responsible for having appropriate tools for detecting and disinfecting harmful computer programs.

Vexia Tech LLC is not responsible for damage caused to Users’ or third parties’ computer equipment during the provision of the Portal service.

4.3 Concerning Service Availability

Access to the Portal requires services and supplies from third parties, including telecommunications network transport, the reliability, quality, continuity, and functioning of which are not under the control of Vexia Tech LLC. Consequently, the services provided through the Portal may be suspended, canceled, or become inaccessible prior to or during the provision of the Portal service.

Vexia Tech LLC is not responsible for any damages suffered by the User resulting from failures or disconnections in telecommunications networks that lead to the suspension, cancellation, or interruption of the Portal service, whether before or during its provision.

4.4 Concerning Content and Services Linked Through the Portal

The Portal access service includes technical linking devices, directories, and even search tools that allow Users to access other pages and Internet portals (hereinafter, “Linked Sites”). In such cases, Vexia Tech LLC acts as an intermediary service provider under Article 17 of Law 34/2002, of July 12, on Information Society Services and Electronic Commerce (LSSI), and will only be responsible for the content and services of the Linked Sites to the extent that it has actual knowledge of their unlawfulness and has not deactivated the link with due diligence. If the User believes a Linked Site contains unlawful or inappropriate content, they may notify Vexia Tech LLC in accordance with the procedure established in clause 6, without such notification implying an obligation to remove the link.

Under no circumstances shall the existence of Linked Sites imply the existence of agreements with their owners or operators, nor the recommendation, promotion, or endorsement by Vexia Tech LLC of the statements, content, or services provided therein.

Vexia Tech LLC does not know the contents and services of the Linked Sites and is therefore not responsible for damages caused by the unlawfulness, quality, outdated nature, unavailability, error, or uselessness of the contents and/or services of the Linked Sites, nor for any other damage not directly attributable to Vexia Tech LLC.

6. Reporting Unlawful or Inappropriate Activities

  • If the User or any other Internet user becomes aware that Linked Sites refer to pages whose contents or services are unlawful, harmful, degrading, violent, or contrary to morality, they may contact Vexia Tech LLC providing the following information:
  • Personal data of the informant: name, address, telephone number, and email address;
  • Description of the facts revealing the unlawful or inappropriate nature of the Linked Site;
  • In cases of rights violations, such as intellectual or industrial property, personal data of the holder of the infringed rights if different from the informant.
  • Documentation proving the legitimacy of the rights holder and, if applicable, authorization to act on their behalf if the informant is not the holder;
  • Express declaration that the information contained in the complaint is accurate.

The receipt by Vexia Tech LLC of the communication described in this clause shall not constitute, as provided in the LSSI, actual knowledge of the activities and/or contents indicated by the informant.

The documentation proving the legitimacy of the rights holder and, if applicable, the authorization for representation must also be provided when the informant is not the rights holder.

7. Notifications

All notifications and communications made by the parties shall be valid when made through the means permitted by law. Notifications related to this Portal shall be considered effective, for all purposes, when made through the Portal itself.

8. Modifications

Vexia Tech LLC reserves the right to make any modifications it deems appropriate to its website without prior notice, including changes, deletion, or additions to the content and services provided, as well as the manner in which they are presented.

Furthermore, these terms and conditions may be modified at any time. Modifications become effective from the moment they are published.

9. Social Networks

Vexia Tech LLC is present on various social networks and platforms. Therefore, when accessing any of these or other networks, you must take into account that the applicable terms of use are those established by each platform, over which Vexia Tech LLC has no control.

10. Legislation

This Legal Notice is governed in all respects by Spanish law. Provided that applicable law allows the waiver of jurisdiction, the courts of Málaga are designated to resolve any disputes, and the user expressly waives any other jurisdiction that may correspond.
